Spark Legal and Policy Consulting proudly announces the successful completion of a comparative study conducted for the European Commission (DG GROW) on merger rules concerning associations within the European Union.
In support of the European Commission’s project to enhance legislative initiatives pertaining to cross-border activities of associations in the single market, this study provides valuable guidance and insights. The study encompasses a detailed legal analysis of the existing legislative framework as well as a concise overview of the prominent trends observed across the EU 27.
Notably, the data collected revealed that only 60% of Member States (16 out of 27) have established legislation addressing merger rules for associations. While associations may still merge or demerge in the absence of a legal framework, it becomes imperative to establish clear and harmonised rules to facilitate their activities in the single market.
Furthermore, the legal framework of merely three Member States currently incorporates provisions for cross-border mergers. These findings underscore the pressing need for clarity and standardised regulations to facilitate seamless cross-border cooperation among associations.
