Results of Study on the Antitrust Procedural Framework

The current framework for the application of EU competition rules is governed by Regulation 1/2003 and Regulation 773/2004, which have been pivotal in shaping the EU antitrust procedural framework over the past 20 years.

In collaboration with Deloitte, Spark supported the European Commission’s Directorate-General for Competition (DG COMP) in evaluating these Regulations, following the European Commission’s Better Regulation Guidelines. The evaluation assessed the Regulations against key criteria such as efficiency, relevance, effectiveness, coherence, and the EU-added value of these legal instruments.

Spark gathered and analysed feedback from a diverse group of EU competition law experts. We collected feedback from legal practitioners, in-house counsel, and National Competition Authorities, to support the evaluation of the Regulations.
